Legal Question in Personal Injury in California

car rental

I would like to know if I can file a small claims on car rental reimbursement for an accident that I was in. The other driver was not insured and had promised to pay for the rental car I had until my car was in the repair shop. He paid a partial amount. But, not the remaining balance.

If it was the other driver's fault, he/she should pay for car rental, the repair costs, and for any injuries you suffered.
