Car rented to minor. Does insurance apply?
A car was rented to a 20 year old. The car rental company can only contract with 21+ year olds. There was a major accident. The car rental insurance policy only allowed for $15,000 per person. Does this still apply if the contract was negotiated with a minor. Is there a possibility of suing the rental company for breach of contract, or more money?

A person who is 20 years old is not a minor.

A person is no longer a minor once they turn 18. However, you are on the right track. According to federal law you must be 25 years old to rent a car. Therefore, you may be able to hold the rental car company responsible for some of the damages since they rented a car to a person under 25 years of age. Before I can advise you whether it would be worth it to sue the rental car agency I would need some questions answered ie. how much damage was done to your vehicle, what kind of injuries did you sustain, information that is vital in determining what your case is worth. There are many issues that need to be analyzed regarding this situation. Unfortunately, based on the information you have given there is not enough to give a competent response. Any response I were to give now would likely be misleading and cause more harm than good. You already have been given some "general rules" in the prior responses such as a minor in California is under 18 years old and relating to the age at which a vehicle may be rented.
The injured person really needs to discuss with an attorney all of the facts and address the legal issues involved.
