Legal Question in Personal Injury in California
Carrier Wants A Statement My Attorney Says
My attorney emailed me and said ''the carrier wants a statement - not sure if I will agree.'' If I email him back, the answer could take a long time since he's busy so I figured I'd ask you what he means by this. This is a personal injury case, btw...

Re: Carrier Wants A Statement My Attorney Says
Most carriers like to interview the claimant through his attorney to "evaluate" the claim. Some attorneys don't like the idea of giving the insurer, and possibly later its attorney a claimant version of the claim before litigation. The statement is generally recorded, either in person or by conference call. You should leave the question to your lawyer.

The insurance carrier wants to send someone to your lawyer's office to tape record a statement from you. The investigator will ask questions, and you will answer to the best of your ability.
Many personal injury lawyers prefer that a statement only be given during a lawsuit because they assume that the insurance carrier won't pay, anyway, and will use the "free" information against you when you file the lawsuit.
