Legal Question in Personal Injury in California
After my case was settled everyone got paid, the chiropractor and the lawyer..at least that's what I thought. The clinic where I got my xrays at are now charging me for the xrays the lawyer didnt pay. Now the clinic is telling me that because the lawyer is ignoring them, I have to be the one to pay the clinic. What do I do?

Immediately write the attorney to demand that he take care of the problem with the clinic and that you do not plan on giving back any of your money as otherwise you would not have settled.
IT IS YOUR ATTORNEY'S OBLIGATION TO NEGOTIATE ALL MEDICAL LIENS BEFORE HE PAYS YOU OUT WITH A FINAL DISBURSEMENT. YOUR ATTORNEY DROPPED THE BALL AND NEEDS TO TAKE CARE OF THIS.
It is unclear at this point whether or not your attorney signed a lien for the x-rays you obtained. If you obtained those x-rays before you hired the attorney or the attorney's office did not sign a lien for the facility where you had those x-rays done, then the attorneys office is nor responsible for such payment and probably issued the payment to you without paying the x-rays, thus relying on you to take care of the payment. An attorney is not obligated to pay for the medical bills, unless there is a lien signed by the attorney. You need to find out if the attorney signed a lien for the facility where you got the x-rays done first. If he or she did not, then you would be responsble for the x-ray payments.
