A case of UI and Cap

Hi,

My wife involved in a car accident, which caused her headache and pain in her face muscle for lifetime. It was another driver's fault and she has no insurance. According to our current lawyer, we cannot pressure further other than getting pay with the cap premium amount of the UI (Un-insurance) within our own insurance policy. My question is that true? Or we just need to look for another lawyer who wants the job.

The other driver paid a fine of $250 to DMV and that's it? She got away so easily for causing the pain of lifetime for someone else. Where is the fairness then? I thought there is a way to getting a court order to let other driver pay from her future paycheck, is that true? Someway has to ensure she pay for her fault (drove into red light with way over speeding) Otherwise, she would easily do the same again and hurt some other people again with a $250 fine.
