Legal Question in Personal Injury in California

child injured at school

I was told my son was running and tripped and fell receiving a cut on his eye requiring medical attention.(stiches) This is a private pre-school(daycare),what are my options for payment of medical?, and is my son entitled to compensation for pain and suffering?

You could probably argue that the school was negligent in its supervision of the children.

It appears that the medical damages may not be that great to merit the time and money you might spend to recover your medical expenses. Generally, there can be pain and suffering recovered.

It depends. The main question is why or what caused your son to fall. If there was/is a defect on the floor/ground or was it his carelssness? There is also the issue of proper supervision. So, you might have some recourse available on negligent supervision or premises liability theories, but it needs to be carefully investigated first. from the facts given, a legal theory for recovery would have to be established. it appears from the facts given so far, your best argument would be that of negligence on behalf of the daycare center. however, i would need you to email more specific details on what actually occurred as told to you, as well as the extent of your child's physical injuries. then i may be able to further assist and/or represent you legally in this matter.
