Legal Question in Personal Injury in California

Children stole my car keys and totalled my car

Four kids were visiting my daughter at my house. All of them--acting in concert--conspired to and did steal my car keys from my purse inside my bedroom wherein the door was closed and access to such room was strictly off-limits to said children. One child drove off with the car, another drove it afterwards and crashed. The other two kids helped planned the theft and were present in the car at the time of the accident. QUESTION: which children are liable here; are their parents also liable for negligent supervision/vicarious liability? Who should I sue and are they jointly and severally liable? What are my rights and what damages might I recover?

Why are you suing anyone so quickly? If you have insurance, file a claim and let them deal with it. That is why you have insurance.

If you do not have insurance, did you file a police report? If so, and charges are filed by the DA, make a claim for restitution.

If no charges are filed and you do not have insurance, you will have to sue them in civil court. You would just name the kids and their parents and let them work it out, but it may be a difficult case, especially if there is no police report. Your easiest bet: insurance.
