Legal Question in Personal Injury in California

is this common?

Quick question:

My car broke down on the freeway and was rear ended by another driver. The police report states that the other driver was at fault. The other driver was injured while I am fine. However, the other driver's insurance company is frantically trying to blame other things (repair mechanics for my car, tire company for my tires, etc.), & is stalling on paying for my totaled car.

Is this a common tactic for insurance companies?

Depending on the claims adjustor and insurance company, they will try to stall you--just make sure you don't pass the statute of limitations period, which is one year for personal injury (6 months if against a government entity) and at least two years for property damage claims (damage to car, etc.).

It's the claims adjuster that you're dealing with. And each one is different. However, why don't you let your (under your comprehensive and collision part of your policy) insurance company replace your car less your deductable, and deal with the other insurance company?
