I was in my company car hen I got rear ended. The car was totaled and my employer sent me to the local clinic for a check up. They cleared me the same day to go back to work...its been a couple of weeks and now my lower back is been hurting...I went to chiropractor and he said I had a strained back? the insurance adjuster form the gentleman who hit said they would pay for any medical bills...do I need an attorney? according to the chiropractor I need to be seen for at least three months...I never been in an accident before and I dont want to affect my work but it seemed to me my boss was more worried about his workers comp. than my well being...please help..

Three months of treatment by any medical provider seems excessive. If you want the carrier to pay for the DC treatment you might need an attorney. You should go to a good orthopedist to see if anything really is wrong with you or if it is just a sore back that will improve with limited exercise, rest, ice, and elevation.

It's not a problem to get medical treatment in your situation, as long as you have an attorney. If you don't want to use work comp (and many people don't, because the system is so bad), having an attorney on the case allows you to treat on a "lien." That means that the doctor sends the bill to the lawyer and waits until the case settles to get paid. Doctors won't agree to treat you on a lien, though, unless you have an attorney vouching for the merit of the case. I know and work with many chiropractors and orthopedists throughout Los Angeles county. Give me a call, and I'll be glad to help you out. You have both a work comp case against your employer, and a third party case against the driver. You can choose to prosecute one, or both, but there will be a third party credit if you do select to prosecute both.

95% of my practice is workers comp and personal injury, so I'm well versed in both. In order to make a selection as to what case you would like to pursue, it is very important to consult an attorney. You can contact me tomorrow afternoon. I have trial tomorrow morning. Contact me on my cell phone around 2:00 at 818.943.0462.

It sounds like you have a case - I would pursue personal injury, rather than comp. Call me to discuss (free call) at (818) 783-7998. -Rob

If you only concentrate on personal injury case, you will end up paying for your treatment from your settlement and also you will not receive any temporary disability benefits if you need to apply. So you need to do both. Feel free to call us at 213.388.7070 for a free consultation.
