hi, if a condo homeowner has proven mass amounts of mold contamation in his residence is the HOA responsibile for homeowners relocation fee's while all repairs are in progress???also who is responsible for all expenses occurred to empty out the entire contests of condo prior to mold redimation? thank you very much

It depends on the cause of the mold. If the HOA is legally responsible for the water intrusion and consequent mold, then the HOA is responsible for all damages that foreseeably arise from it. The condominium unit and the common areas are not really much different from two adjacent properties. If one property owner has a condition on his property that causes damage to the other property, he must pay all the damges that arise from it, including all costs of remediation. If that includes relocation and moving and storage expenses, and loss of use then they are included.
