PI plaintiffs often go to trial while they are still being treated. After all, some injuries require treatment for many years, or even for life. The plaintiff just has to offer the best evidence she can about her prognosis and her anticipated future expenses.

If you are changing lawyers at the last minute, you are not entitled to a continuance of the trial on that basis. The court might give you one anyway, but it could say no -- especially if this seems to be a delaying tactic. As Mr. Tasjian says, the new lawyer will make the request.
