Legal Question in Personal Injury in California

which county do I sue in?

I was in a car accident in San Francisco with a driver who lives in another county about 10 miles south. Do I have take him to small claims court in the county that he lives in, the county where the accident was or do I have a choice?

Hello.

First, I wonder why small claims court? Was it just a minor accident for which you don't intend to claim more than $7,500? If so, your plan is correct.

You have an option to sue in one of the following counties: 1. where the accident occured; 2. where the defendant resides. So, the San Francisco Court on 400 McAllister is the right place to sue. Alternatively, you could sue in... I guess San Mateo County if it's more convenient for you.
