Legal Question in Personal Injury in California
coverage
My son was struck by a vehicle that was driving on the wrong side of a two lane street in the complex where we live. He was riding his bike. If the police failed to note that the vehicle was on the wrong lane on the police report is there any way to ask them to correct that omission ?
Thank you for your time.

Re: coverage
I hope your son is making a good recovery. Yes, please contact the police agency immediately, and explain to them what it is you want. If it's within the investigating officer's memory, he/she should make the change. Please let me know if there's anything further I might help you with.
Re: coverage
Yes. You can file a supplemental report with the dept. under the same report number and ask that your supplemental be made part of the actual report. Most policy agencies will do this. They usually will not change the original report. If you have witnesses or other evidence, use that in your own report. If you wish to discuss any injury claim for your son and are in Southern Calif., please call.
Re: coverage
How do you know. If you were a witness and did not give a statement, call the police and let them know you want to give a statement. If some other witness did not give a statement have them do the same thing. If witness statements were given that showed that to be the case but the police report did not reflect this, call the police and speak to the supervisor to complain and ask for a supplemental report to be made. Otherwise send a statement and ask that it be made part of the police report.
The police report is not evidence of what occurred or of fault unless the policeman witnessed the accident or unless physical findings at the scene preserve evidence from which the facts can be inferred such as measurement and location of skid marks, etc.
You should have your son represented by legal counsel. Don't go this alone.
Re: coverage
Supplemental report can filed. However, any supplement that is made after the conclusion of investigation is generally viewed with mistrust.
Witness statements should be obtained at once. A good investigator is usually employed in these cases. Good luck.
