Legal Question in Personal Injury in California

We think she is crazy!

My mom about a year ago was trying to sell her car and a girl at work needed one so my mom said she could start making payments on it, everything stayed under my moms name and the girl paid $40 a month for insurance when it was $80 dollars that my mom was paying, the insurance was still under my mom. The girl totaled the car and now wants everything that my mom got from the insurance which was $4,500. And $500 dollars for her medical bills, she still owed my mom $500 dollars for the car and she didn't even give my mom the full payment of insurance.She is now sueing my mom, what are her chances??

Your mom's not crazy; she sounds very good-hearted, trusting, and na�ve. In essence, your mom let the woman borrow the car in exchange for her contribution to the insurance payments and the debt (it seems). If there was no other arrangement (i.e. that the driver would be the owner), then it's almost a no-brainer.

Now, I take it, your mom has the car back and has received the insurance check to fix it (or total it). Obviously, your mom retained an interest in the car since the loan, title and insurance are in her name. Sounds like a case for Judge Judy. I'd side with your mother.
