Damages for loss of consortium/int. inflic of emotional distress

Plaintiff wife sues ex-paramour of husband because for a few weeks Husband had sexual relations with girlfriend and wife (age 68) claims that her usual sexual relations of 3 times per week with husband did not occur because he had sex with girlfriend a couple of weeks. Plaintiff's attorney is claiming intentional intentional infliction of emotional distress with the damages being loss of consortium for a few weeks.

this type of case is outlawed in CA by civil code 43.5. the plaintiff attorney is an idiot. The court will dismiss the case upon a simple application by any competent defense attorney.
