Legal Question in Personal Injury in California

My daughter was the passenger in a car accident 3 years ago.

She suffered injuries from the seat belt. Now those injuries have resulted in damaging to her lymphatic system and has been diagnosed with Lymphedema. What can we do to get help for her? Can we be reimbursed from the drivers insurance co.? For medical bills etc.

Assuming the accident occurred in CA, if your daughter is a minor, you can proceed by going after the responsible party. If your child is no longer a minor (under 18) but was at the time of the accident, you may be able to proceed; however, there might be a statute of limitations issue.

Mr. Reed is correct. Most such cases are handled on a fee percentage basis and if she still is a minor the insurance company may request court approval of any settlement which may also reduce the attorney's fees.
