Legal Question in Personal Injury in California

Dealer responsibility

My car was damaged while the mechanic for the dealer was taking a test drive. A truck backed into the front of my car. What should be the dealer's responsibility and response to the accident?

Re: Dealer responsibility

Who was driving the vehicle that struck yours? If it was a dealer employee, then they should pay for the damages. If this was a private person, then the person who struck your car should pay. You may want to use your collision coverage, let your insurance company pay the repairs, and then let them collect back. But, if the mechanic was not at fault for the accident, then the dealer has no responsibility to pay for the repairs to your vehicle.
