Legal Question in Personal Injury in California
dealing with a claims adjustor
i got in a car accident over a year ago and have been dealing with the other party's claims adjustor since. we cannot agree on a settlement amount. i feel that the amount she is offering is too little. how can i justify that the settlement amount needs to be increased?

Re: dealing with a claims adjustor
I am not saying that this is true in your case, but many people do not want to hire an attorney to handle their personal injury claim because they do not wish to giver up any of their money that they get from an insurance company for legal fees. Insurance companies are well aware of this and as such, they usually try to take advantage of the plaintiff by giving low settlements. Probably the best way to help insure that you are getting an appropriate settlement is to hire an attorney.

Mr. Lupoff offers some good advice. Nevertheless, if you have an estimate from a reputable body shop as to the cost of repairing the car, that would be good evidence of what the property damage payment should be.
Re: dealing with a claims adjustor
A couple of things are at play: (1) the adjuster is aware that you have no attorney and that you will not be suing them anytime soon, so they will low ball you; (2) you may be over evaluating your case.
