Default of a Settlement
I need some serious help here. I was the plaintiff in PI case. Due to some disagreements after a binding arbitration i fired my attorney and settled the case. Attorney went ahead and asked the arbitrator for a discission and one for attorney's fees. Arbitrator gave an award plus attorney's fees. Now, when i settled the case, i made two agreements, one for me as to what I would receive along with hem paying other bills. Two, a personal agreement with defendants to pay attorny fees and costs. They have breached both agreements. Now I, along with the then defendants are being sued by my former attorney. I need cases and codes to site for a default and cross-complaint against other defendants. Can I request the settlement be set aside and ask for what the arbitrator awarded.

You're right -- you do need help. The only way to advise you how to proceed would be to review the various agreements (including your initial fee agreement with the attorney) and see exactly what was going on.
