Legal Question in Personal Injury in California

defective puppy

I purchased a chihuahua from an out of state breeder (Ohio), they said she had a clean bill of health from the vet. With in 48 hours I took her for her 1st vet check as required. The vet said she has PDA (congenital heart disease). I have had 3 Vets that say the same thing. The breeder sent a sick puppy in hopes that I would not know. This puppy needs surgery or she will die. The breeder wants me to return the puppy for another one. I don't want another puppy. I believe they should pay for the surgery. And they should not be aloud to send defective animals to unsuspecting people. The Vet on their end that examined the puppy lied about her health and I have the paper work. The Vets on my end that did the examen on her said she was born with PDA and there is NO way it could be missed. I need help with this situation. There is another case similar to this going on in NV. I an Attorney that loves dogs as much as I do.

You would have to sue the breeder in Ohio or in superior court in California. It will be expensive. You will probably have to pay an attorney hourly as you are entitled to recover the value of the dog or the cost of the surgery, whichever is less.
