Legal Question in Personal Injury in California

Disclosure of Medical Information

I am being sued in small claims court by a physician for a past due bill. In section one of the small claims filing, the physicians office listed my diagnosis and treatment. Pursuant to sec 56.35 of the Calif civil codes, isn't this illegal? I am very upset that my personal information was released wihout my permission and available for review by anyone. Can I sue for damages?

Re: Disclosure of Medical Information

I think you have a god case for damages against

the doctor, however I think you should sue him

in Superior Court so that your damages are not

limited to $5,000.00. A patient doctor privilege

is a very important one and when a doctor violates

that privilege it is a very serious matter. I would

be happy to give you a free consultation and discuss

various courses of action against the doctor as well

as what kind of damages I think we could get in court.

I could probably represent you on a hybrid of part hourly

and part contingency fee. Why don't you give me a call

at 805-546-9909 or email me at [email protected] with

your information and I would be happy to give you

a call at your convenience. I am located in San Luis Obispo

which is on the central coast but I practice throughout

the state of California. I look forward to discussing

this case with you.
