Legal Question in Personal Injury in California

dog bite

If a neighbor's dog reaches over an ajoining fense into my yard and my dog bites its foot, I'm I laible? Additional information. My side of the fense is 5' high, the neighbor's side is 3'1/2 high since they added a retaining wall.

Owner must keep his dog on his side of the fence.
