Legal Question in Personal Injury in California

dog bites neighbor's dog

My dog a pit/mix, supposedly, bit my neighbor's silky terrier on the leg. We heard a comotion outside and when we looked out, we saw our dog in the yard with the gate shut and our neighbor on the other side of the fence holding his dog saying our dog bit his dog. The next day we get a note saying our dog was out of the gate and bit his dog so, he put our dog back in the gate. Let's also say that his dog is always running loose on the street (many witnesses to this) and comes through our fence into our yard. Our dog is very socialized, goes to doggy daycare, goes to dog parks with no problems, and was temperment tested at the SPCA (where we got her). The owner is now asking that we pay all expenses. I'm willing to pay half since both our dogs were loose, but am I liable to pay at all since we are not even sure if our dog bit his dog?

Follow Mr. Roth's advice!

Offer to pay half of the bill, and do not go one cent higher, unless some witnesses appear to confirm or deny whether or not one dog was in the wrong yard.

Say no, pay half and let your neighbor sue you in small claims court if she disagrees. She probably will not win.
