Legal Question in Personal Injury in California

Emotional distress claim arising from property damage action

What specific case law and/or authority can I cite that pertains to animals being considered 'property' and therefore, no emotional distress claim can arise from loss of animal (owner viewed her pet mauled/killed by other dogs) High profile.

Re: Emotional distress claim arising from property damage action

This is a very difficult question. My firm handles many such cases. There is a general principal that agrees with your position. However, there are cases that hold the other way. It depends upon the specific facts of the case. I would sugeest that you have your home owners or renters insurance provide you a defense. I would suggest that you advise any insurance you have about the claim. If you would like to contact me directly please e-mail at [email protected]
