Emotional Distress Damages in Dead Dog Case

Can an owner of a dog that died due to the negligence

of another person potentially recover emotional distress damages and/or any other kind of pain and suffering damages from that person in either by way of a cause of action for property damage and/or a cause of action for negligent infliction of emotional distress in California?

I note that your letter was submitted on June 29, 2000 and because of the delay in posting by LawGuru.com, I am just now able to advise you.

Although historically, pets were treated as personal property with no emotional distress attched to their value, in recent years some California courts have been awarding emotional distress damages for the injury or loss to a pet. There are a number of factors that go into these decisions and each case is handled individually.
