I note that your letter was submitted on June 29, 2000 and because of the delay in posting by LawGuru.com, I am just now able to advise you.
Although historically, pets were treated as personal property with no emotional distress attched to their value, in recent years some California courts have been awarding emotional distress damages for the injury or loss to a pet. There are a number of factors that go into these decisions and each case is handled individually.
There are a few attorneys that specialize in these animal rights cases. I suggest that you call attorney Michael Rotsten in Encino, California at (818) 789-0256. Please tell him that I referred you to his office. I wish you the best of luck.
Sincerely,
