Legal Question in Personal Injury in California

As an emplyee of a private school, If I pick up 2 students each from their respective homes and bring them to and from school, do I carry the liability should an accident occur? The school told me I am not on their insurance policy unless I drive their company car. I think it's too big of a risk seeing it's over 100 miles per day.

Yes you have some risk. You might check with your auto insurer to see if there is an exclusion since it is work related.

Simple answer is you are 100% responsible for these children and any negligent acts. The next question is who has to pay. Again you are primarily responsible, but if you were in the course and scope of your employment then your employer has to indemnify and defend you for any tort or negligent act that you caused while on the job.

So the main question is whether or not it part of your job to pick up these students or are you doing someone a favor?

Good luck and hope that helps.
