Legal Question in Personal Injury in California

Fall in bathrom

While reaching out of the bathtub for a towel the towel rod broke and I fell down as a result .I was 33 weeks pregnant and I also dislocated my left elbow for which I had to undergo surgery and am currently undergoing physiotherapy. Is it wise to sue the apartment owners for personal injury? We moved into the apartment only 20 days before the incident

Re: Fall in bathrom

You may have a very good case. It depends on several issues. How old was the towel rod? When was it last inspected by the landlord? How close was it to the bathtub? How was it attached to the wall. An expert would have to inspect and advise if there is a valid claim. Seek the advise of an attorney who specializes in personal injury claims. Contact me with any questions.

In order to prevail in such a lawsuit you will be required to show that the landlord knew or should have known that the towel bar was in bad repair and was likely to break. Otherwise, I don't see how the landlord would be liable for your injury.
