Fall in gym parking lot

I fell in my gym parking lot after my workout and ended up with a severely sprained ankle. I went to the emergency room directly from the parking lot, but did not notify the gym of the incident(frankly, I was in too much pain to move or talk to anyone). I ended up missing three days of work because of my injury (I lost the wages because I was out of sick time) and now have bills from the emergency room, doctor's visits, and physical therapy. Is it too late for me to contact my gym? What steps should I take? Thank you!

I'll second Jeff Olster's answer, but add that your medical bills are important, so keep track of those and find out whether the doctor recommends further treatment (therapy, etc.), what it costs, do it, and save the records.

In California, you have one year from the date of injury to bring a claim. (Note -- If the gym is government owned or operated, your time-frame is significantly reduced). Thus, if your fall happened recently, you should be ok.

Based on the information you provide, you should make a claim for your medical bills, lost wages, and an additional sum for pain and suffering (that is, of course, assuming that the injury caused you pain and suffering).

You can make and negotiate the claim yourself. However, you are likely to obtain a better settlement if you enlist the services of a personal injury attorney.
