Legal Question in Personal Injury in California

False Insurance information

Invioved in a rear end collision, traded information, lady that hit me addmitted fault, but her insurance information was false. We didnt make a police report,because we wanted to settle it with out the insurance. And i have yet to make a dmv report.

I wanted to know what steps can i take to ensure i get some money for my damages. And i didnt have insurance myself.

First of all, file a DMV report. Regardless of whether you feel you will want to handle a situation without reporting to insurance, this is still a state law requirement. It's a requirement for any accident with over $500 in property damages. Then, you have to get the money for your property damage from the other person, if there is no insurance. If they don't give it over to you, then you may have to sue them. Also, if there is another registered owner (other than the driver) on the other vehicle, perhaps this is a possibility for locating insurance or naming them in a suit as well. If you had uninsured motorist coverage, your own insurance company would have covered you. Whatever you do, please protect yourself next time.

You lose on both ends. Don't make a DMV report cause your license may get suspended. You'll have to sue the other driver in small claims court for property damage or injury up to $5000.00.
