Legal Question in Personal Injury in California

No Fault Automobile Accident

I was in an automobile accident with a garbage truck. From the police report and a statement from a witness, it was the other driver's fault. I was not injured in the accident but had ~$6000 worth of damage to my vehicle. I was wanting to know how to collect my deductible costs, lost wages, etc.

I don't understand how there would be lost wages if you were not injured in the accident. As to your deductible, your insurance carrier will recover for its costs from the other carrier. Notify you carrier that you want them to have the other carrier cover the whole cost and reimburse you for the deductible.

If damages not in excess of $5,000.00, file small claims action.
