Fear of Bad Representation

This is a follow up to an earlier question (Acceptable Offer???) about the glass wall shattering over my wife at a Orange County shopping mall. She is now being threatened with court cost of $65,000 by her attorney if we don't settle now and a jury may not even award the original $15,000. Witnessing the lack of preparedness of her attorney at mediation we have lost confidence are worried about being represented by him. We have tried to obtain another attorney but with the court date less than a month away and living in Northern California nobody is interested. Some of the points I failed to mention earlier are that the defendant, a major corporation, have claimed liability and this has happened at least 4 times before. An engineers report was supposed to have been done but we haven't heard results. We are worried about future medical problems and a recent visit to a new doctor confirmed our worries. An MRI was ordered immediately but feel we have run out of time for this case. This is where we feel her attorney and her previous medical plan failed her. If we had the financing to pay for an MRI earlier out of our pocket our attorney may not have even worked for enough of a settlement to pay for it. Would appreciate any help.

If the accident was in Orange County, isn't the trial there? I commented before that the settlement value depends upon how good the liability case is. I can't judge that from anything you provide in the way of information. You had better get confidence in your attorney soon or change attorneys. If you have a good reason to lose confidence the court should be willing to accommodate a brief continuance to allow new counsel to get up to speed.

You should sit down with another attorney to review the merits of your case, the status of the lawsuit and the merits of your lawyers' arguments. A second opinion should really help you decide what to do, and you might want third and fourth opinions as well. Be prepared to pay the attorneys for their time, since they are unlikely to want to step in at this stage and since they will not offer free consultations on a case that they know they won't get.
