Legal Question in Personal Injury in California

In February of this year I went along with my duaghter to set up our booth for a home show in Los Angeles convention center. While stepping on a chair to hang up banners, I fell and hurt both hands and wrists. I fell because when I was done and wanted to step down I tripped on an uneven carpet. I had a surgery on my right hand as a result of a fluids and inflammations. I spoke with 2 lawyers and I was told that hands injuries are hard cases and that it is hard to win anything. How come?

I have done a serious wrist injury, and did fine. How much was your surgery out of pocket? Does it affect your work? Did they provide ladders?

I can't think of any reason you were told that. On the other hand, unless your contract for your display space included terms that the promoter would provide set-up equipment, I see a major proportional negligence case. Between the fact that you used a chair instead of a proper ladder, the fact that uneven carpet is something anyone can see if they look at it, the fact that you were standing on a chair instead of a proper ladder, the fact that they could parade through a dozen people who will testify that trade-show carpets are temporary and are never perfectly even, and the fact that you were standing on a chair instead of using a proper ladder (yes I know I'm repeating myself - to make the point), the percentage of liability that will be assigned to whomever provided the carpet, will be zero to very little, and the percentage of liability that will be assigned to you will be almost all of it to all of it. That is why I think attorneys have little interest in your case.

I am not sure why you were told by other attorneys that hand injuries are hard cases as I have represented many clients with hand injuries and have prevailed. I would need to know some additional information regarding the carpet which caused you to fall and the circumstances around the fall. However, you should certainly retain an attorney to represent you in this matter and to ensure that your rights are protected against the defendant's insurance company.

My law firm strictly only represents injured people like you in personal injury cases. I fight for my clients rights and I provide everyone with personalized attention. I work on a contigency basis which means that I only get paid if there is a settlement. So if there is no recovery, you don't owe me a fee. You can call me for a free consultation at (888) LAW-1177.
