About fee structure. In a contingency case of medical product liability & personal injury where company has recelled an implant and it is not going to trial, what is the most common fee structure? Is there any standard referral fee?

Most attorneys handle these cases on a contingency fee of 1/3 until the case goes to mediation, Mandatory Settlement Conference or Trial when the fee goes to 40%. Referral fees are only allowed to go to another attorney for referring the case. The referral fee is usually between 10% and 33 1/3%. Referral fees cannot go to non attorneys.
