Legal Question in Personal Injury in California
I fell off a step ladder. The steps on the ladder stick out past the frame and are very sharp. My leg was cut badly. I had to go to the emergency room for stitches. I later had to be treated twice for infections in the wound. I didn't have medical insurance and incurred about $2000.00. in medical expenses. Can I sue the manufacturer of the ladder for my medical costs? If so, how long do I have to file a suit?

The answer is yes, subject to a full investigation of course. It sounds as though you have the fundamentals of a product liability case. Exactly how strong the evidence of liability, and exactly how severe the damages, remains to be seen. You have two years to file a lawsuit, but if you wait until then to go get a lawyer, you probably won't find one interested in taking the case. If you're going to hire a lawyer at all, you need to do it now, so that the case can be properly worked up from the beginning. An otherwise good case can become spoiled by lack of good handling; that's why hiring a professional early on is the best idea, especially since it costs you nothing up front. And, for goodness sakes, save the ladder! Save the receipt for the ladder! Don't let it out of your hands! Do not contact the manufacturer except through your own attorney.
