Legal Question in Personal Injury in California

I want to file small claims action for slip and fall on behalf of myself and my toddler who was also injured. Because it is two separate plaintiffs and one defendant can I sue for $7500 each or a total of $7500 for both of us? Also are these hard to prove in court? Insurance investigator even admitted liability

I believe that you can seek $7500 for each plaintiff in small claims court. They are difficult, since you need to prove more than you fell. You need to prove the store was negligent in either maintaining the store, they created the dangerous condition, or that they should have known of the dangerous condition. In court the investigator may not give you the proof that you need to prove liability.

Yes, you can it is per person but you would have to file two claims. Also you will have to have someone to be appointed as a guardian for your child to sue for their claim.
