Legal Question in Personal Injury in California
I filed a law suit in Small Claims Court for an auto accident. The suit named 2 defendants. One is the driver that hit my car (his front to my front) and the second defendant is a third driver who was making an unsafe turn. The first driver (the hitter) claimed he was not at fault because he was trying to avoid the second driver/defendant. Both insurance companies have denied my claim and I was not paid for my losses - car and personal injuries.
The summons were sent out court date today. The second driver/defendant showed up with her insurance adjuster. The court clerk informed us that the first defendant did not confirm receipt of his summon.
Upon researching via the internet I think the defendant has moved to Canada. Can I serve him in Canada? What are my options? Sue the insurance companies instead of the individual drivers? Thank you.
