Filing an Answer
I'm being named on a lawsuit with a rental car company by an indivudal who claims they were injured and their car damaged. I have been subpoenaed/summoned and I need to file an answer. I basically need to know if I can file the answer myself and if so, are there instructions for doing so. If not, is there an agency or law firm who can help me complete this answer so that I may comply with the law, without having to pay a lot of money. I am a single mom with a couple of children and I don't have lots and lots of money for this. Thank you.

Did you or the vehicle have insurance? If so, they will handle for you. If not, you can find forms for answers by searching for California Judicial Council Forms.

You should check with your own insurance company and/or if a credit card was used to rent the car, you often have automatic coverage. However, if time is pending (you have thirty days to file an answer once you are served) you should file the answer first and then investigate your coverage situation. There are form answers avaialble, however consulting an attorney may be more wise. If you are in the area and need further consultation, please do not hestitate to contact this office.

Call the rental company and see if they will represent you. You should also notify your insurance company.
