someone is filing a personal injuries claim from an accident that occured over 9 months ago, under what ground is it possible for me to counter sue?

If you had personal injuries or property damage from the accident, first give the lawsuit to your own insurance company; and consult an attorney about countersuing.

If the accident was the other person's fault, or partially the other person's fault, you have the right to file what is called a cross-complaint. Your own insurance company will defend the case against you and you would need to retain your own attorney for the cross-complaint.
