Legal Question in Personal Injury in California
I have a friend who was the driver in an accident that resulted in death as he struck an elderly gentleman crossing he street who passed away 3 days later. This happened some 8 months ago and he has been stressing about it ever since. He was finally charged with vehicular manslaughter without gross negligence. He is worried he will lose his license and face a fine, as work has been slow for him and either jail time or a fine would really cripple him. What is the usual penalty for this?

Um, has Your Friend considered the fact that vehicular manslaughter is a felony, and all felonies carry the risk of a state prison or jail sentence? I hope you urge Your Friend to hire a criminal defense lawyer right away. A lawyer can help him get the charge reduced or can even beat the charge (accidents are not a crime). If he is not convicted, there will be no penalty. Aside from the prospect of jail time and/or fines, the way the charges are resolved could have an impact on his civil liability, including whether or not an award of damages could be discharged in a future bankruptcy filing; and his ability to be employed.
