Legal Question in Personal Injury in California
I have a friend who stored her RV at a county fairground for $110.00 monthly. A tree fell on it damaging it pretty badly. She did not have it insured, she was not going to drive it. I doubt she even had comprehensive insurance. Insurance was required and the contract states "failure to have insurance is a breach of the contract. The contract also states that the Fairground is not responsible for any damage to the property. My friend had pointed out to the manager that the tree appeared to be ready to fall on her RV yet they did nothing. When the tree fell, they did not call her, she found out from another friend who had a vehicle there. When she arrived they were cleaning up the tree and cutting it up with chainsaws and she had them stop so she could take pictures. Does she have any recourse?
1 Answer from Attorneys
She violated the contract, so she is stuck.
