Legal Question in Personal Injury in California
Hello,
In December of 2009 I was pulled over for expired tags by the Lomita Sheriff. It was found that I had two outstanding warrants, one for annoying phone calls to my girlfriend 10 years ago, which was dismissed by the court in Long Beach the following day. The other was a failure to pay $100 restitution in a vehicle code violation 15 years ago.
I was sure that I had paid but had to spend serveral harrowing days in County Jail until I was given time served. I have just found the court receipt showing that I indeed did pay in full in 2005. This was a very traumatic experience where I was nearly assaulted, almost lost my job and missed spending time with my dying mother. As a former paralegal, I know I am entitled to compensation, please let me know if you are interested in the case.
Thanks,
Jeff

Yes. Ordinarily I'd like the case a lot. But you have blown the six-month Government Code claims statute. If you have a good excuse (mistake, surprise, excusable neglect) you can file an application for leave to present a late claim. It is not a violation of civil rights case, it's simple negligence (against the county of LA). Maybe the fact that you only now found the receipt will help.
