Legal Question in Personal Injury in California

Hi

I live in a apartment complex, i was leaving the complex and the automatic gate came down on my car prematurely as i was waiting to engage into the street. Is my apartment liable for this? Do i still file with my insurance company?

Make your claim to the Apt manager. They may try to say that you delayed in getting through, and it is your own fault.
