Hit by a car backing up
I got hit by a Toyota Sienna car while it was backing up. My 5 year old son was with me and fortunately nothing happend to him. The hit made a dark red mark on by backside and I was totally under shock. I collected the insurance from the lady who was driving the car. What is the next step to do

Follow the advice of Mr. Lee and Mr. Roth.
Re: Hit by a car backing up
By collecting on her insurance, you most likely signed a full release and waiver of any cause of action against her insurance company. You will want to check that release and waiver to see if you also waived any cause of action against their insured, the driver. Because that's the only person left to sue if you have not been made whole by the insurance policy limits (I'm assuming) payoff. I can refer you to a good PI attorney if you want to consult.

If you were not seriously injured, which from your description seems to be the case, sue the driver in small claims court or contact her insurer and see what they will offer for your injury. If it seems adequate, without being dramatic, take it. On the other hand, if you have serious injuries that will require a course of medical or chiropractic care, contact a lawyer.
