Legal Question in Personal Injury in California

Hit in face by baseball bat

On Jan 1st I was struck in the face intentionally with a baseball bat by another man. I would like to know if it's worth it for me to try and sue. Here's the story:

I live at an apartment complex that is also a fraternity house. Only fraternity members live here and I have my own apartment. On New Years there was a small party. One of the guys had an altercation with another member. He then got mad and called his father. His father came and brought another man who carried a baseball bat with him. I was not involved with this at all. I happened to be inside of one of the rooms in the apartment complex when the guy with the baseball bat came in. He was looking for one person in particular (not me). He hit me with the bat to get me out of the way because I was standing on the stairs.

My injuries are minor. I didn't go to the hospital, only the doctor. I had a black eye and a small permanent scar. It does still hurt somewhat in the back of my eye, but the doctor can't find any permanent injuries.

We have video tape of the man with the baseball bat and the father that brought him, but no name of the guy. The father would probably have to be subpeonad to get his name. There was a police report and pictures taken

Re: Hit in face by baseball bat

Do you have photographs of your injuries? How much were your medical bills? Do you have him hitting you on video? How many witnesses and evidence do you have that he hit you with the bat? Intentionally? How much money does the person who hit you and the other person have? You can email me if you want to pursue a suit - there may be something there if they have money.

Best,

You clearly have a case. However, it is not clear whether it is worth pursuing. As others have suggested, more facts are needed to determine this. If you would like a free phone consult, contact us.
