Legal Question in Personal Injury in California

I hit some one that is illlegal in this county, and has no lic or insurance. Our insurance company paid his damage to car , but would not pay bodily due to no proof. Now he is sueing me for lose of work and dr bills. in small claims court. My quiestion is I want to counter sue him for negligence ?? If not how can i make it to become a LAW . P.S. he is mexican, but I am too only born .here..

Someone who lacks insurance coverage cna only collect for out of pocket expenses--medical bills, property damage, loss of income, but not pain and suffering. You should ask your insurance company why it has not paid the rest of those damages; any judgment against you for those items must be paid by your insurance or you can sue them. Being an illegal resident is not negligence.
