Legal Question in Personal Injury in California

Hospital Lien vs Uninsured Motorists Coverage

I have a uninsured motorist claim pending with my insurance company. I was told the hospital I was treated at has filed at lien against any recovery I receive, stating I gave them lien rights on the Conditions of Admission I signed along with a written lien they sent citing Civil Codes 3045.1. 3045.1, 3045.3 & 3045.4. Does my insurance company have to honor these liens?

This is a complicated area. Your ins. co. normally doesn't handle these liens--you do out of your settlement. But sometimes these liens can be negotiated based on different criteria. You should have a personal injury assisting you. If you are in So. Calif, give me a call for a free consultaion.
