Legal Question in Personal Injury in California

my husband was in a car accident 1 month ago where the guy lost control of his truck getting on the freeway and took down the pole. the truck was damaged on the passenger side which my husband was the passenger. He couldn't seek medical attendtion because he has no insurance. At the time of the accident the guy told my husband he had no insurance but come to find out now he did have insurance and filed a claim with them cause he has another car now and has bragged about it.
