Legal Question in Personal Injury in California
My husband was told during an interview that he would receive health insurance for the entire family in 30 days after the start date of his employment, which was Aug 3rd. We received insurance cards and money is being taken out of his paycheck each week for his portion of the insurance. My daughter had a skating accident on Sept. 19 and we went to the ER. We were told we did not have insurance coverage.
Is the insurace company liable for this charge since we were told we would have insurance 30 days after start of employment and it is now 48 days after his start date and they have our money taken out of his pay.
Is the skating rink liable in any way. I did sign a waiver before she began skating.

It depends who is at fault in not processing properly the insurance coverage. You need to find out if it was the employer or insurance carrier. Also, what were you told about there being no coverage [policy does not cover that type of accident, not within correct geographical area, etc.]. It appears youshould have coverage ad the employer and insurance carrier must tell you clearly why they claim you do not.
As to whether the skating rink has any negligence as to the accilent, you do not tell us any of the facts so how can we guess at whom is to blame?
