Legal Question in Personal Injury in California

I was injured in an apartment building

elevator. I was there visiting a friend. We got onto the elevator( me my girl my buddy and his dog) when the door closed the dogs leash became trapped the elevator started to go down and the leash began to choke the dog. So I reached down and grabbed the dogs collar to help the dog. The collar eventually broke and two of my fingers were nearly severed. The dog lived. But I had to have surgery. Am I resposible for medical bills. And if there is something I can do, is there a time limit? This happened about 1yr ago... Thank you, a dog lover

In general, there is now a two year period of time to bring a tort action for negligent injury to you. You would have to find out if the elevator was designed not to operate when something was trapped in the door and why it failed to function in that fashion. Was it a mistake in manufacturing, installation, maintenance, or other control over the elevator, did the building owner or cleaning people make it malfunction? Was it designed that it would not stop because of the leash being stuck; if so, is that the common industry design or is that negligent?

You need to speak to several attorneys to see who you want to handle the case.

You would have two years from the date of your injuries in the elevator within which to bring your lawsuit. You should definitely hire an attorney in order to make your claim against the owner of the property assuming the property was privately owned. There may be an insurance policy which will cover your injuries. Your lawyer can make a claim against the property owner.

If the property was publicly owned, you have less than two years. You may need to make a claim with the public entity in charge of the elevator as soon as possible.

Where did this accident occur? Who owns the property? An attorney can help you figure out the answers to these questions. If this occurred in San Diego, I would love to speak with you. I can be reached at (619)991-0548. Good job helping the dog!
