Legal Question in Personal Injury in California
I have been injured in a car accident in the San Francisco Bay Area more than a year ago. I have done most of the work to collect documents (medical bills, doctor reports, etc) and I even prepared and submitted a formal Settlement Demand letter for my claim to the insurance company. I have a strong case and I am well prepared to defend my case in the court if I decide to file a lawsuit in a proper court of jurisdiction. But this will be a lengthy process. As you are aware, the insurance company is not taking me seriously to negotiate for a fair settlement when I do not have a lawsuit on file.
Can I find a good, skilled auto accident attorney who would be willing to accept %20 of my recovered losses (it is a ready case) to negotiate on my behalf for a reasonable settlement prior to a lawsuit?

I'm not going to give you copy/paste answers like the "canned" responses above. I'm going to give you the facts and I'm going to give it to you straight. My fees are standard: 33% pre-litigation, and 40% on the filing of a lawsuit. I only charge less when representing minors, as required by law, and that is 25%. I have many years of experience (first in claims then as an attorney) and I too have a standard 1/3 pre-litigation fee requirement and would be glad to discuss the case with you and can contact me if you are interested but I doubt many attorneys would agree to cut a contingent fee especially since many cases require litigation.
